Yes, without restriction. You don't need to be a resident or hold Spanish nationality. You'll need an NIE (Foreigner Identification Number) and, in most cases, a Spanish bank account to handle payment and the related taxes.

The NIE is the number that identifies any foreigner for tax purposes in Spain; without it, you can't buy, sell, or pay taxes in the country. You can apply for it at a police station in Spain or at the Spanish consulate in your home country. Our firm handles this application on your behalf under power of attorney, so you don't need to travel.

It depends on whether the property is new or resale. New-build properties are subject to VAT (10%) plus Stamp Duty (1.2% in Andalusia); resale properties are subject to Transfer Tax (7% in Andalusia). On top of this, notary, land registry and administrative fees.

It's not mandatory, but we strongly recommend it. A Spanish will speeds up the probate process for your assets in Spain and avoids conflicts between the succession laws of both countries. Without one, your heirs usually face longer and more expensive procedures.

It's the Non-Resident Income Tax return. If you own a property in Spain and don't rent it out, you must file it once a year on the property's imputed income. If you do rent it out, you must file it quarterly on the rental income earned. The deadline and applicable rate depend on your country of tax residence.

Yes, provided you obtain a tourist licence from the Junta de Andalucía and meet the requirements (registration number, complaints form, minimum property standards, among others). This is a separate regime from long-term residential leases, which fall under Spain's Tenancy Act (LAU), so it's worth being clear on which use you intend for the property before deciding.
